Koh Samui Land

From a buyer’s perspective, land on Samui is still an attractive option. Many foreigners with a legal avenue to own land have chosen to buy on Koh Samui, both for investment purposes or to build their own house. In the long term as the island can only continue to grow thanks to its idyllic location and constantly improving facilities, infrastructure and services. With demand cooling recently, due to uncertainties surrounding foreign ownership prices are stable. Currently, the biggest impediment to land ownership is the Thai law that forbids foreigners owning the land. Many foreigners place the ownership in the name of a Thai spouse or company that has only 49 percent foreign ownership. A foreigner however can own the buildings freehold. Another option available in order secure land is a 30 year renewable lease. However safeguards need to be written into the contact, as any sale of the land would render the lease invalid. With a good lawyer, good advice and estate agent, people can generally buy with peace of mind and security.

There are several types of land ownership in Thailand, but you should always consider a deeded property. The deed in Thai is called a chanote and a lawyer will be able to help with the land transfer for a fee, but make sure he does the due diligence properly. It is possible to do the property transfer at the land office yourself, but the lawyer option is worth the money considering all contracts and documentation must be in Thai language.
